25 deputies want homosexual couples to have different rights than heterosexual couples, fewer rights, actually. These 25 deputies seem to believe that being able to marry or enter civil union is enough.
The plan made by these deputies is troublesome. It would not allow a foreigner to obtain Costa Rican citizenship by way of a homosexual marriage, as is possible via a heterosexal one. Additionally, in the case of divorce, a pension would not be given. The couple wouldn’t be able to adopt together. If one adopted or had a biological child and later passed away, the surviving spouse wouldn’t get custody of the child or even be considered as a potential guardian.
Lastly, there would be a separate registry for homosexual marriages and civil unions, unnecessarily segregating them from heterosexual unions.
International human rights standards disagree with all of this. The Inter-American Court of Human Rights has ordered Costa Rica to guarantee homosexual couples access to all the same legal protections and rights that heterosexual couples have.
