The Environmental Court has ordered the demolition of a $2 million work in Ciudad Quesada because it was built on protected land. The decision will have the owners destroy a wall and building, remove the debris and even reforsest the land.
The one-story building and wall were erected in the protection area of a nascent in San Carlos. The Forestry Law indicates that areas bordering permanent springs in a radius of one hundred meters are areas of protection and works of any kind are prohibited there.
First to notify the responsible party was Sinac, which issued a precautionary measure against the construction company. Even after the confirmation of the Water Directorate works were not stopped because the building was already completely done.
The matter was then raised to the Courts. The measures to enforce compliance to the order are on hold because the responsible company has started a contentious process to appeal.
